You must have been rolling on the floor laughing [in annoyance, probably] when you saw the difference in immersion character at design load.

Unfortunately, even if the claims are stupid, you can't afford to laugh at them. They must be taken seriously. Once a patent is issued, it becomes incumbent on the "infringer" to prove that they are not infringing.

This can be done one of two ways (both expensive):

1) Demonstrate that the "infringing" design is not actually covered by the patent.

or

2) Prove the patent is invalid in the first place.

Option 1 is impossible if the patent was awarded for exactly what you as the "infringer" are doing. Option 2 is extremely hard because of all the hoops you need to jump through. You end having to prove "Fraud" which means you need to prove the patent holder intended to patent something knowing full well that prior art already existed. Proving someone intended to fake something vs they were just dumb, in court, isn't easy.

What these cases really come down to is a battle of intimidation. The patent holder can threaten to take you to court, which will cost enough that you will probably go bankrupt, while the "infringer" can threaten to let it go to court which may cost the patent holder can afford plus threaten to counter sue for fraud which could send someone to prison.

It is a game of chicken that is only amusing after it is long over.
